Welcome to EfficaxOne! These Terms of Service (“Terms”) govern your use of the EfficaxOne website and its associated services, software, and applications (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Service.
1.1 This agreement constitutes an order for online outsourcing services for Quantity Survey Works and other similar services as agreed upon by both parties, whether or not explicitly stated herein.
1.2 EfficaxOne is liable only to provide the services agreed upon at the signing of this agreement. Any additional services requested by the client are provided at the sole discretion of EfficaxOne.
1.3 This agreement will come into effect once the Client signs up for an online service or uses any service offered through efficaxone.com.
2.1 To access certain features of the Service, you must register for an account. When you register, you agree to provide accurate and complete information and to keep this information updated.
2.2 You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account or password.
2.3 Subscription plans offered by EfficaxOne are subject to the payment terms set forth in this agreement. Each subscription plan has its own terms and features, which are described in detail on our website.
3.1 The Client agrees to pay in full for all packages or A La Carte Jobs at the time of signing this agreement. Full payment is due within 5 business days of the receipt of the invoice.
3.2 The Client may not withhold any payments for works performed on behalf of the Client.
3.3 Payments not received by the due date will result in a cessation of work. EfficaxOne reserves the right to refuse completion or delivery of work until past due balances are paid. Clients on a monthly subscription will have a 5-day grace period before work ceases.
3.4 If payments are delayed for more than 10 calendar days, EfficaxOne may cancel the Client’s registration at its own discretion. At such time, this contract may become void.
4.1 The Client acknowledges that EfficaxOne is not an employee but a partner in a collaborative, professional relationship. Mutual professional respect, courtesy, and consideration are expected.
4.2 Due to the virtual nature of the service, the Client must communicate promptly, especially via email, and respond to questions, requests, and communications from EfficaxOne in a timely manner.
4.3 The Client understands that EfficaxOne requires clear, detailed instructions to meet expectations and deliver high-quality work.
5.1 Office hours are Monday through Friday, 8:00 AM to 5:00 PM, (+5:30 GMT, Colombo, Sri Lanka Time Zone). Communications received outside these hours will be addressed on the next business day.
5.2 All communications should be directed through the Client Portal accessible at portal.eogestimates.com or via email to [email protected].
6.1 The Client will provide all necessary materials for any special projects. These materials must be clear and legible.
6.2 The Client is responsible for the accuracy of information provided to EfficaxOne.
6.3 EfficaxOne reserves the right to cancel any job if provided materials are inadequate to perform the requested service or work.
7.1 The Client assumes full responsibility for the acceptance of work or services performed and agreed upon, as well as for final proofreading and accuracy.
7.2 EfficaxOne will perform Quality Assurance to ensure high-quality services but expects the Client to conduct their own review to ensure satisfaction.
7.3 Major changes requested by the Client may incur additional charges, depending on the agreed rate or package selected.
8.1 The Client shall indemnify and hold EfficaxOne harmless from any suits, costs, damages, or proceedings related to any litigation in which the Client is a party.
9.1 Either party may terminate this agreement upon 28 days written notice to the other party. Immediate termination is permissible in the event of a breach of this agreement.
10.1 EfficaxOne shall not disclose any confidential information pertaining to the Client, during or after the term of this agreement, without prior written consent from the Client.
11.1 The terms and conditions of this Agreement may be modified or amended as necessary, only by a written instrument signed by both parties.
